<h4 class="wp-block-heading"><strong>The Common Travel Area</strong>&nbsp;</h4>



<p>The Common Travel Area (CTA) is a longstanding arrangement allowing free movement of Irish and UK citizens across both jurisdictions. This means Irish and British citizens do not require visas or residence permits to live or work in either Ireland or Northern Ireland. However, for non-Irish and non-British nationals, immigration rules diverge sharply at the border.&nbsp;&nbsp;</p>



<h4 class="wp-block-heading"><strong>Calculating Residence in Northern Ireland for Irish Citizenship</strong>&nbsp;</h4>



<p>Irish law requires “reckonable residence” to be physically in the State (the Republic of Ireland). Time spent living in Northern Ireland does not count towards the residency requirement for Irish citizenship, save in the case of a spouse or civil partner of an Irish citizen which treats time in the “island of Ireland” as reckonable.&nbsp;</p>



<h4 class="wp-block-heading"><strong>Frontier workers&nbsp;</strong>&nbsp;</h4>



<p>EEA/Swiss and non-EEA citizens who were living in one jurisdiction and working in the other (frontier workers) prior to 1 January 2021 retain their rights.&nbsp; Those taking up their frontier worker status after that face more complex requirements post-Brexit, including permits and compliance with both Irish and UK immigration systems.&nbsp;&nbsp;</p>

<p>As of 13 January 2025, the responsibility for first-time <a href="https://mcgrathmullan.ie/immigration-lawyer-dublin/" data-type="link" data-id="https://mcgrathmullan.ie/immigration-lawyer-dublin/">immigration</a> residence permission registrations across all counties in Ireland has been transferred from the Garda National Immigration Bureau (GNIB) to Immigration Service Delivery (ISD), under the Department of Justice.</p>



<p><strong>Where to register</strong></p>



<p>All first-time registrations must now be completed in person at the registration office located at 13-14 Burgh Quay, Dublin 2. To book an appointment, applicants must create or log into their account on the Digital Contact Centre (<a href="https://portal.irishimmigration.ie/en/" target="_blank" rel="noreferrer noopener">https://portal.irishimmigration.ie/en/</a>). Each appointment is linked to the applicant&#8217;s unique profile.</p>



<p><strong>Required Documents</strong></p>



<p>Applicants must bring:</p>



<ul class="wp-block-list">
<li>A valid passport or equivalent document.</li>



<li>A completed address form received with the appointment confirmation email.</li>



<li>Printed copies of all required supporting documents.</li>



<li>A €300 registration fee (if applicable), payable by credit or debit card. Contactless and cash payments are not accepted.</li>
</ul>



<p><strong>Transition period for Garda stations</strong></p>



<p>For appointments already scheduled at Garda stations outside Dublin, Cork, Kildare, Limerick, Meath, and Wicklow up to 31 January 2025, the Garda will complete these registrations. If applicants prefer to switch to ISD, they can notify the relevant Garda station and book a new appointment with ISD.</p>



<p><strong>Renewals</strong></p>



<p>Renewals continue to be processed online through the ISD portal, eliminating the need for in-person attendance. Applications for renewals are accepted up to 12 weeks before the current permission expires.</p>

<p>If you are a retired non-EEA national, with sufficient financial resources, and you would like to relocate to Ireland on a long-term basis, then the Stamp 0 <a href="https://mcgrathmullan.ie/immigration-lawyer-dublin/" data-type="link" data-id="https://mcgrathmullan.ie/immigration-lawyer-dublin/">immigration </a>permission might be a suitable option for you.</p>



<p>It is essential that you are retired from all forms of employment as any form of economic activity in the State is not permitted at the time of application, during the application process, or after your Stamp 0 permission is granted.</p>



<p>You must also demonstrate that you have sufficient financial resources to support yourself financially in the State. In this regard, the Department’s Guidelines ask for proof that you have access to an annual income of €50,000, together with a lump sum amount to cover any sudden major expenses. A lump sum amount should equal the cost of a private residential dwelling.</p>



<p>In order to demonstrate you have sufficient financial resources to support yourself, you are required to submit a report from an Irish accountant verifying your finances. If you engage us to handle your Stamp 0 application on your behalf, we can arrange the preparation of this report on your behalf with an independent Accountancy Firm.</p>



<p>A number of additional documentary proofs will also be required for this application, along with a completed application form.</p>



<p>If your Stamp 0 application is approved, you must travel to Ireland to complete the final steps of the process.</p>



<p>Your Stamp 0 permission will be granted for one year and can be renewed on an annual basis provided you continue to meet the conditions of the permission – among other things, that you continue to meet the financial requirements and have been residing continuously in the State.</p>

<p>As of 4<sup>th</sup>&nbsp;November 2024, the Irish Immigration Service Delivery (ISD) will officially take over responsibility from the Garda National Immigration Bureau (GNIB) for the renewal of residence permissions across all counties in Ireland. From this date, all applicants nationwide must use the ISD online renewal portal to submit their applications.</p>



<p>This change means that applicants no longer need to attend the Burgh Quay Registration Office unless specifically required. Applications for renewals can be submitted up to 12 weeks prior to the expiry of an IRP card, ensuring enough time for processing.</p>



<p>Applicants must ensure all required documents are uploaded before submitting an online renewal, as incomplete submissions will not be processed. Certain categories of applicants, such as refugees and family members of EU citizens, are exempt from the €300 registration fee.</p>

<p><em>This notice, published on the Irish Immigration website, highlights important information for non-EEA nationals planning to travel over the upcoming Christmas holiday period.</em></p>



<p>The Immigration Services Registration Office in Burgh Quay, Dublin, is currently handling a high volume of renewal applications, with processing times estimated at 3-4 weeks. After the renewal process is completed, it may take an additional two weeks to receive the new IRP card by mail. A valid IRP card is required for travel into and out of Ireland.</p>



<p>To assist non-EEA nationals legally residing in Ireland who plan to travel over the Christmas holiday period, the Minister advises submitting renewal applications online by&nbsp;<strong>31 October 2024</strong>&nbsp;if your current permission expires before or during your travel.</p>



<p>Non-EEA nationals needing to renew their IRP card for international travel during the holiday season should use the ISD online portal and apply as soon as possible. The registration office cannot guarantee that renewals submitted after 31 October 2024 will be processed in time for Christmas travel, though they will strive to do so.</p>



<p>Note: The new permission&#8217;s validity will be calculated based on the expiry date of the current permission, regardless of when the renewal application is submitted.</p>

<p>There are a number of ways a child can claim Irish citizenship:</p>



<ol class="wp-block-list">
<li><strong><u>Automatically an Irish citizen</u></strong></li>
</ol>



<p>A child will automatically be an Irish citizen if:</p>



<ul class="wp-block-list">
<li>They were born on the island of Ireland before 2005</li>



<li>They were born abroad to an Irish citizen parent who was born on the island of Ireland before 2005</li>



<li>They were born in Ireland and their parent was living in Ireland for 3 of the 4 years immediately prior to their child’s birth</li>



<li>They have been adopted by an Irish citizen</li>
</ul>



<p>In these cases the child may simply apply for an Irish passport from the Irish Passport Office.</p>



<ol start="2" class="wp-block-list">
<li><strong><u>Eligible for Irish citizenship but application required</u></strong></li>
</ol>



<p>A child under 16 may be eligible to apply for Irish citizenship if:</p>



<ul class="wp-block-list">
<li>One of their parents has already been granted Irish citizenship through naturalisation;</li>



<li>They are of Irish descent or have Irish associations, and have a period of reckonable residence in Ireland (usually at least 3 years); or</li>



<li>They were born in Ireland after 1 January 2005 and have since accumulated 3 years of reckonable residence in Ireland</li>
</ul>



<p>‘Reckonable’ residence means time spent in Ireland on an immigration stamp which can be counted towards a citizenship application – not all types of immigration stamp are reckonable.</p>



<p>In these cases, the child’s parent, guardian or a person acting ‘in loco parentis’ must apply for Naturalisation on their child’s behalf to the Department of Justice. If the application is granted the child will then be an Irish citizen entitled to apply for an Irish passport.</p>



<p>A child may also be eligible for Irish citizenship if:</p>



<ul class="wp-block-list">
<li>They have a grandparent who was born on the island of Ireland; or</li>



<li>They have a parent who, though born abroad, was an Irish citizen at the time of their child’s birth</li>
</ul>



<p>In this case, the child’s parent or guardian can submit a Foreign Birth Registration application on their child’s behalf to the Department of Foreign Affairs. If the application is granted the child’s name will be entered onto the Register of Foreign Births, and they will then be an Irish citizen eligible to apply for an Irish passport.</p>

<p><br>&nbsp;One of the key updates involves the transfer of responsibility for first-time registration and renewal of Irish immigration residence permissions for individuals residing in Meath, Kildare, and Wicklow. Previously managed by the Garda National Immigration Bureau (GNIB), this responsibility has now transitioned to the Immigration Service Delivery (ISD) of the Department of Justice.<br>&nbsp;<br>As of 8th April 2024, individuals in Meath, Kildare, and Wicklow seeking first-time registration can do so at the Registration Office located at 13-14 Burgh Quay, Dublin 2. <h4 class="wp-block-heading">Update to eligibility requirements for Stamp 4 upgrades</h4>



<p> Another notable update relates to the eligibility criteria for a <a href="https://mcgrathmullan.ie/immigration-lawyer-dublin/" target="_blank" rel="noreferrer noopener">Stamp 4 upgrade</a>, particularly for individuals on Stamp 1 or 1H permissions. Effective since 15th  November 2023, the Department of Enterprise, Trade, and Employment ceased the provision of Stamp 4 support letters, prompting a review by ISD.<br> <br>Following the review, eligibility for a Stamp 4 upgrade has been revised, now allowing employees on Stamp 1 or 1H permissions to qualify for a Stamp 4 upgrade after 21 months of employment in the State under specific categories, including Critical Skills Employment Permit, Hosting Agreement as a Researcher, or Multi-Site General Employment Permit as a Non-Consultant Hospital Doctor.<br> <br>Alternatively, individuals on General Employment Permits are eligible for a Stamp 4 upgrade after completing 57 months of employment in the State.<br> <br>Importantly, categories for eligibility are not interchangeable, and the documents required for registration remain unchanged.
