<p>McGrath McGrane LLP (McGrath Mullan) recently settled a case for in excess of €68,000.00 having been instructed by a client who suffered an accident at work. The client suffered significant personal injuries when they slipped in a stairwell at their workplace and fell down several stairs. As a result of the fall, our client suffered personal injuries to the back and neck.</p>



<p>We advised the client that the employer has a responsibility to provide a safe place of work for employees. In these circumstances, we believed that the employer had failed to do so and therefore would be found responsible for the injuries suffered by our client. The employer has a statutory duty under the Safety, Health and Welfare at Work Act 2005 (as amended) to provide and maintain a safe workplace for employees.</p>



<p>McGrath McGrane LLP (McGrath Mullan) initiated a claim on behalf of our client against the employer. We made an application to the Personal Injuries Assessment Board (PIAB) on behalf of our client and the employer consented to the case being assessed by PIAB. PIAB assessed the client’s claim at a figure in excess of €54,000.00. Although it was a substantial award, McGrath McGrane LLP (McGrath Mullan) advised the client to reject the award, as we felt it was not sufficient compensation for our client’s injuries.</p>



<p>If the client did reject the assessment, they would have to issue Court proceedings in order to further their claim.</p>



<p>The assessment was accepted by the client’s employers. This meant that if our client rejected the assessment and failed to recover a figure greater than the €54,000 in the subsequent Court proceedings, the client could not receive an order for the costs of those proceedings.</p>



<p>Our client decided he would take McGrath McGrane (McGrath Mullan) LLP’s advice and reject the PIAB assessment. We notified PIAB that our client was rejecting the PIAB assessment and PIAB issued an authorisation to proceed to Court. We then issued proceedings in the High Court on behalf of our client.</p>



<p>McGrath McGrane (McGrath Mullan) LLP subsequently settled the client’s case for a sum in excess of €68,000.00*.</p>

<p>McGrath Mullan LLP was instructed by a client who had been involved in an accident while at work. The client who was working in the bar industry unfortunately suffered a bad injury to their foot as a result of a beer keg falling on it.</p>



<p>We advised the client in relation to their right to mount a personal injuries claim and we wrote to the client’s employer in this regard.</p>



<p>The firm made an application to the Personal Injuries Assessment Board (PIAB) on behalf of the client and the insurers of our client’s employer consented to the matter being assessed by PIAB. PIAB issued an assessment which included an assessment of general damages for “pain and suffering” in excess of €60,000.00. McGrath Mullan LLP advised the client that we felt the figure, although substantial, was not enough and we advised the client to reject the assessment which had been accepted by the insurance company of the client’s employers. The client took the advice of McGrath Mullan LLP and rejected the PIAB assessment. PIAB then issued its authorisation, on the basis of which, McGrath Mullan LLP issued High Court proceedings on behalf of our client.</p>



<p>We subsequently arranged settlement discussions and settled our client’s case for a figure in excess of €85,000.00. The client was very happy that they had taken the advices of McGrath Mullan LLP in rejecting the PIAB assessment and was delighted with the settlement outcome.</p>

<p>McGrath McGrane LLP was instructed by a client who had been involved in an accident at work. While removing goods from a high shelf, the client fell off a step ladder and suffered personal injuries of a soft tissue nature.</p>



<p>We initiated a claim on behalf of the client, who was employed by a supermarket chain. The employer of the client investigated the accident and also raised a series of questions, regarding the circumstances of same.</p>



<p>McGrath McGrane LLP responded to the queries indicating that certain information requested by the employer would be detailed in the proceedings to be issued on behalf of the client, if that became necessary.</p>



<p>No admission of liability was furnished and consequently an engineer was engaged by McGrath McGrane LLP on behalf of the client.</p>



<p>An application was then made to PIAB (Personal Injuries Assessment Board) so that the claim could be assessed. The employer of the client consented to the assessment of our client’s claim by PIAB and ultimately PIAB issued an assessment in excess of the sum of €20,000. This assessment was accepted by the employer and our client.</p>



<p>The client was very happy with the result which was achieved without the necessity of having to issue proceedings.</p>
