Insurance Claims and Bad Weather – What to Do First, and When to Contact a Solicitor

There will unfortunately be a lot of home owners, business owners and car owners up and down the country looking at hefty bills for repairs following Storm Éowyn.

Hopefully a lot of this damage will be covered by an insurance policy of one kind or the other – whether that’s a home insurance policy, a commercial policy or a car insurance policy.

What To Do First

If you have suffered damage and are looking to make a claim on your insurance, there are a few things you should do to make the best claim you can, and to ensure that your insurer :

Keep records of the damage – Take photos and videos of the damage, and take notes of the time and who took the photographs.

Contact your broker and report the damage as soon as you can – Even if you don’t follow through on the claim, every policy will have a time limit on when a claim can be filed. Some can be as short as a few weeks from the date of the damage.

Stop any further damage – Make the property safe, and minimise the risk of any further damage being caused.

Keep the receipts – If you pay for any services or repairs (including temporary accommodation), keep the receipts safe and in proper order.

Don’t overlook the small things -a small hairline crack could be the sign of something more significant. If it’s not brought to the attention of your insurer, it could be a basis of a refusal.

Don’t dispose of evidence – Depending on the circumstance and timelines, and so long as it isn’t an ongoing danger, don’t make any significant repairs or dispose of any “evidence” until an assessor from your insurer has inspected the premises. Items here would include things like fallen tree limbs, loose roofing panels etc.

Refusals And Low Value Assessments – Involving A Solicitor

Most claims do not require the input of a lawyer.

However, not all insurance claims are straightforward, and insurance companies can and do make incorrect or indeed wrongful decisions.

If you have been refused coverage or given a low valuation, McGrath Mullan can advise and fight on your behalf.
