How we can help
Conveyancing Fees and Services
- For a house with a value up to €360,000.00, our professional fee would be in the region of €1,995.00 plus VAT (total €2,453.85). For the purchase or sale of an apartment the fee would be €2,250.00 plus VAT (€2,767.50), given the extra work involved concerning management companies. Commercial Leases and Business Premises
- Lease Agreements: McGrath Mullan provide comprehensive legal services for both short-term and long-term business leases. Our team ensures that your lease agreement is robust, fair, and aligns with your business needs.
- Full Investigation and Legal Support: We conduct a full investigation of title, review planning permissions, landlord’s title, mortgagee consents, and lease clauses. Our focus is on protecting your business interests, whether you are a tenant or a landlord.
Understanding Short-Term vs. Long-Term Leases
- Short-Term Leases (less than 5 years): Often, short-term leases may not require a detailed legal examination of title, especially if the location is not a critical factor for the business. However, it’s still important to ensure that the terms of the lease are fair and reasonable.
- Long-Term Leases (more than 5 years): For businesses where location and premises are integral, such as restaurants, a strong lease is vital. This includes a thorough investigation of various aspects like planning permissions, landlord’s title, mortgagee consents, and lease clauses.
Key Considerations in Business Leases
-
- Investment and Goodwill: We understand the importance of investment in fitting out premises and the goodwill attached to it. Our team ensures that your lease protects these investments adequately.
- Responsibility for Maintenance: It’s crucial to clearly understand who is responsible for the upkeep and repair of the premises. We help clarify these responsibilities to prevent any surprises or disputes.
- Legal Compliance: Ensuring that the lease is stamped with the revenue commissioners and, where necessary, registered with the Property Registration Authority is a key part of our service.
- Renewal Rights: We also focus on securing your rights to a new lease at the expiry of the term, providing long-term security for your business.
Our Role in your Lease Agreement
Our duty as your solicitors is to conduct an appropriate investigation and provide comprehensive legal advice. Whether you’re taking a short-term lease for an office or entering into a long-term lease for a retail space, we ensure that your lease agreement is robust, fair, and conducive to the growth and development of your business.
