The Intra-Company Transfer Employment Permit is designed to facilitate the transfer of senior management, key personnel, or trainees within multinational corporations.
This permit allows non-EEA nationals from an overseas branch to be transferred to the corporation’s Irish branch, supporting the country’s job growth ambitions and the establishment of foreign direct investment companies.
Eligibility and Criteria
To qualify for this permit, applicants must fall into one of the following categories:
- Senior Management: With a minimum annual remuneration of €46,000.
- Key Personnel: Possessing specialist knowledge, with a minimum annual remuneration of €46,000.
- Trainees: Undergoing a training programme, with a minimum annual remuneration of €34,000.
The permit is not intended for permanent roles but rather for temporary assignments that contribute significantly to the Irish branch’s operations.
The Ineligible List of Occupations for Employment Permits is no longer applied to Intra-Company Transfer Employment Permit applications.
Minimum periods of employment prior to transfer
To be eligible for an Intra-Company Transfer Employment Permit in Ireland, Senior Management or Key Personnel must have been employed with the overseas company for a minimum of six months to demonstrate their integral role in the organization. For Trainees, a minimum of one month’s employment with the foreign employer is required before the transfer.
Upon the termination of employment with the foreign employer, expiration of the permit, or completion of the training program, the foreign national is obliged to return to their country of origin.
Under the Employment Permits Act 2006, a new Employment Permit for a different employer cannot be considered until 12 months have elapsed since the permit holder commenced employment in Ireland. However, Trainees on an Intra-Company Transfer Employment Permit are allowed to apply for a Critical Skills Employment Permit or a General Employment Permit within this 12-month period.
Application Process
Applications are to be submitted via the Employment Permits Online System (EPOS), which offers a streamlined process with benefits such as faster turnaround, secure online payments, and fewer errors due to continuous validation of data and documentation.
Fees for Intra-Company Transfer Employment Permit:
New Permit: €500 for permits up to 6 months and €1,000 for permits from 6 to 24 months.
Renewal: €500 for permits up to 6 months, €1,000 for permits from 6 to 24 months and €1,500 for permits from 6 to 36 months.
If an application is unsuccessful, 90% of the fee is refunded. Refunds are issued to the applicant only, even if a third party paid the fee.
